Fiory - Privacy Policy & EULA

1. Acceptance of Terms

By downloading, installing, accessing, or using the Fiory mobile application (the "App"), available on the Apple App Store, you ("User", "you") acknowledge that you have read, understood, and agree to be bound by this Privacy Policy, End User License Agreement (EULA), and all applicable laws and regulations. If you do not agree to these terms, you must not use the App. Fiory is owned and operated by Fiory Chat Inc. ("we", "us", "our").

We explicitly state that we do NOT tolerate the submission, posting, or sharing of objectionable content or the improper use of the App by any User. Violation of these terms will result in immediate action, including but not limited to account suspension, termination, and reporting to relevant authorities where necessary.

2. Privacy Policy Overview

2.1 Data Collection and Processing (GDPR Compliance)

We comply with the General Data Protection Regulation (GDPR) for all Users located within the European Economic Area (EEA). We collect and process personal data only for the purposes outlined in this policy, and only with your explicit consent where required by law. The personal data we may collect includes:

Account information (email address, username, password hash)
Device information (device model, OS version, unique device identifiers, IP address)
Usage data (App interaction, feature usage, session duration)
Payment data (only for in-app purchases, processed via Apple's App Store payment system; we do not store raw payment details)
User-Generated Content (UGC) as defined in Section 4

Under GDPR, you have the right to access, rectify, erase, restrict processing, data portability, and to object to processing of your personal data. To exercise these rights, contact us at info@fiorchat.com.

2.2 Data Storage and Security

We implement industry-standard security measures to protect your personal data from unauthorized access, disclosure, alteration, or destruction. Data is stored on secure servers with encryption, and access is limited to authorized personnel only. We retain your data for as long as your account is active or as required by law, and will delete or anonymize your data upon your request or account termination.

2.3 Third-Party Sharing

We do not sell your personal data to third parties. We may share data with trusted third-party service providers (e.g., analytics, payment processors) who act on our behalf and are bound by confidentiality agreements. We may disclose data if required by law, court order, or to protect our rights, property, or safety, or that of our Users or the public.

3. In-App Purchases

Fiory offers in-app purchases ("IAPs") for premium features, subscriptions, or digital goods. All IAPs are processed through Apple's official App Store payment system, and Apple's Terms of Service apply to all transactions. We do not collect or store your payment card details; all payment data is handled exclusively by Apple.

All sales are final unless required by law or Apple's refund policy.
Subscriptions (if applicable) will auto-renew unless canceled at least 24 hours before the end of the current period, through your Apple ID settings.
We reserve the right to modify or discontinue IAP offerings at any time, but will not affect active subscriptions or purchased digital goods.

4. User-Generated Content (UGC)

UGC refers to any content (text, images, videos, audio, links, or other materials) that you post, upload, share, or transmit through Fiory (including but not limited to chat messages, profile content, or community posts). By submitting UGC, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute such content for the purpose of operating, maintaining, and improving the App.

4.1 Prohibited UGC and Conduct

You agree that you will NOT submit, post, share, or transmit any UGC that:

Contains sexually explicit, pornographic, or obscene material (including but not limited to adult content, non-consensual sexual content, or content depicting minors in a sexual manner);
Is violent, graphic, grossly offensive, or causes significant emotional distress or discomfort to others;
Promotes or facilitates gambling, betting, or any form of illegal gaming activity;
Promotes, facilitates, or depicts the use, sale, distribution, or manufacturing of illegal drugs, narcotics, or controlled substances;
Contains political propaganda, hate speech, or content that promotes political extremism, violence against political groups, or interference with political processes;
Is discriminatory based on race, ethnicity, national origin, gender, sexual orientation, gender identity, religion, disability, age, or any other protected characteristic;
Infringes on the intellectual property rights (copyright, trademark, patent, trade secret) of any third party;
Is fraudulent, deceptive, or misleading (e.g., phishing, scams, fake news);
Violates any applicable local, state, national, or international law or regulation;
Harasses, stalks, threatens, or intimidates any individual or group;
Promotes or incites illegal activity or harm to others.

4.2 Enforcement of UGC Policies

We reserve the right to monitor, review, and remove any UGC that violates these terms, at our sole discretion, without prior notice. We do not pre-screen all UGC, but will take prompt action to remove objectionable content when identified. We explicitly state that we have ZERO TOLERANCE for Users who post prohibited UGC or misuse the App in violation of these terms.

Consequences for violating UGC policies include:

Immediate removal of the prohibited UGC;
Temporary or permanent suspension/termination of your account;
Forfeiture of any in-app purchases or digital goods associated with your account;
Reporting of illegal activity to law enforcement authorities;
Legal action to recover damages caused by your violation.

You are solely responsible for all UGC you submit, and agree to indemnify and hold us harmless from any claims, damages, or liabilities arising from your UGC or violation of these terms.

5. End User License Agreement (EULA)

5.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use, in accordance with these terms and Apple's App Store rules. You may not modify, reverse engineer, decompile, disassemble, or create derivative works of the App.

5.2 Restrictions on Use

In addition to the UGC prohibitions in Section 4, you agree not to:

Use the App for any illegal or unauthorized purpose;
Interfere with or disrupt the App's servers or networks;
Use automated tools (bots, scrapers, scripts) to access or use the App;
Share your account credentials with others or allow unauthorized access to your account;
Exploit the App for commercial gain without our explicit written permission.

5.3 Termination

We may terminate or suspend your license to use the App at any time, without notice, if you violate any of these terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
